Securities Actions

Hesselman v. Arthur Andersen LLP, et al., Central District of California Case No. CV 02-07874 RSWL(cmx) and Southern District of New York Case Nos. CIV 02-10199 (GEL), Master File No. 02MD 1472 (GEL): represented shareholders alleging violations of the federal securities laws against certain past and then-present director's officers and employees of Global Crossing Ltd., as well as Pacific Capital Group, Inc., Arthur Andersen LLP, and Canadian Imperial Bank of Commerce; case negotiated to a confidential settlement with multiple defendants.  

Weisman, et al. v. G&L Realty Corp., et al., LASC Case No. BC 271401: represented a group of investors and shareholders who unsuccessfully sought to purchase a publicly traded company; achieved a successful settlement. 

Karabinas v. Arredondo, et al., LASC Case No. BC254688: represented injured party in a fraud case related to the sale of securities; obtained a judgment of $10 million.


Catastrophic Injuries

Saul v. Yorba Linda Water District, et al., OCSC Case No. 00CC14623: represented plaintiff in an action for negligence and maintenance of a dangerous condition on a roadway; obtained settlements and a jury verdict for almost $6 million.

Morrison v. Loma Linda University Medical Center, et al., SBSC Case No. SCVSS104635: represented a patient claiming injury as a result of medical malpractice for failure to timely treat a paint injection injury; obtained a jury verdict and collected a six figure judgment for the client.


Intellectual Property and Commercial Litigation

Pogrebnoy v. Russian Newspaper Distribution, Inc., et al., Central District of California Case No. CV 10-08532-PA-SS: successfully defended owners of a California based newspaper against Federal and State claims for trademark infringement.

Gallego v. Steel, Southern District of California Case No. 05CV544 R(wmc): allegations of breach of contract and fraud; obtained a settlement valued at over $400,000.

Louis Vuitton Malletier, et al. v. Fisch Properties, et al., Central District of California Case No. CV 06-4325 PA(RZx): defended a commercial landlord against allegations of vicarious and contributory liability under the Lanham and Copyright Acts for alleged sales of counterfeit luxury items by its tenants; although plaintiffs sought millions of dollars in damages, statutory penalties and injunctive relief, after several weeks of trial, the action was settled with no monetary component, and no injunctive relief against the landlord.

Scottsdale Insurance Company v. Fisch, LASC Case No 99K18171: contract and statutory violations alleged; defense judgment for Barnhill & Vaynerov LLP's client. 

Messagebroadcast.Com, LLC v. Fonevia, LLC, Central District of California, Case No. SACV05-860 CJC (RNBx): an action involving misappropriation of intellectual property; successfully settled.

John S. Fisher, et al., v. Maria Pincu, et al., LASC Case No. SC 066151: an action by tenants alleging breach of contract, fraud and statutory violations, seeking a forced sale of recently concerted condominium units under the Tenant Participating Conversion Act, Santa Monica City Charter Section 20.00; Barnhill & Vaynerov LLP represented former owners of the building (prior to the completion of the conversion process) and obtained a successful settlement on behalf of its clients. 


Health Care and Miscellaneous Qui Tam Actions

People of the State of California ex rel. Allstate Insurance Company v. Weitzman, et al., LASC Case No. BC 179468: Allstate Insurance Company alleged insurance fraud by more than 20 doctors, chiropractors, lawyers, law office managers, and purported cappers, in violation of the Insurance Fraud Prevention Act, Cal. Ins. Code   Barnhill & Vaynerov LLP obtained favorable settlements for its clients in this action.

People of the State of California ex rel. Allstate Insurance Company v. Paul E. Harnitchek, D.C., et al., SBSC Case No. SCV 48876: represented two chiropractors in a qui tam action brought by Allstate insurance Company, pursuant to the Insurance Fraud Prevention Act, Cal. Ins. Code 1871 et seq., wherein Allstate alleged that the medical facility and Barnhill & Vaynerov LLP's clients engaged in up coding of medical treatment provided to their patients in violation of California Penal Code 549, 550; obtained a successful settlement on behalf of its clients.

People of the State of California ex rel. Allstate Insurance Company v. Arthur G. Collins, M.D., et al., LASC Case No. PC 021925: represented three doctors in qui tam action brought by Allstate Insurance Company, alleging violations of the Insurance Fraud Prevention Act, Cal. Ins. Code 1871 et seq., and California Penal Code 549, 550; obtained a successful settlement on behalf of its clients. 

People of the State of California ex rel. Farmers Insurance Exchange, et al., v. Kosal Naing dba Queen Auto Center, et al., LASC Case No. KC032572: represented a former insurance claims representative accused of receiving kickbacks from auto body repair shops; Barnhill & Vaynerov LLP’s client denied all liability and sought equitable indemnity under the California Labor Code from his former employer - the plaintiff in the action; obtained a successful settlement on behalf of its client.
